The USCIS’s EB5 Mission: The U.S. Citizenship and Immigration Service (USCIS) administers the Immigrant Investor Program, also known as “EB-5”, created by the U.S. Congress in 1992 to stimulate the U.S. economy through job creation and capital investment by foreign investors. A certain number of EB-5 visas are set aside for investors in Regional Centers designated by USCIS based on proposals for promoting economic growth. Over the last 20 years, billions of dollars of EB-5 and non EB-5 capital have been invested through regional investment centers with a special emphasis on geographic areas which historically do not have access to capital.
Advantages of a Regional Investment Center: Projects seeking Eb5 funding must meet crucial business plan technical requirements, demonstrate job creation pursuant to 8 CFR §204.6(j)(4)(B), and provide documentation of the investment structure and offering documents. A foreign investor investing in a project under the auspices of a designated regional center benefits from the added jobs created by a “job multiplier” aligned with a regional economic benefit analysis methodology, such as IMPLAN. The experience and success of a regional investment center is a major factor in immigration lawyers and migrant brokers recommending a project to an investor petitioner seeking to obtain “green card”.
